CEQ is conducting the Permitting Innovators Call for Solutions (“the Program”) pursuant to authorities under the National Environmental Policy Act (42 U.S.C. 4331(a)) and the America COMPETES Act (15 U.S.C. 3719). Luminary Labs is administering the Program under contract with the National Aeronautics and Space Administration (NASA) Tournament Lab. CEQ, NASA, and Luminary Labs are collectively referred to herein as “Program Parties.”
Rules, terms, and conditions
Eligibility Requirements
To be eligible to receive nonmonetary recognition through the Program, an entrant (whether an individual, group of individuals, or entity) (“Entrant”) —
- Shall have submitted a submission for the Program under the rules promulgated by Program Parties, as published in this Call for Solutions: Rules, Terms, and Conditions (the “Rules, Terms, and Conditions”);
- Shall have complied with all the requirements set forth in the Rules, Terms, and Conditions;
- Shall not be a federal entity or federal employee acting within the scope of their employment;
- In addition to subparagraph (c), shall not be an employee of CEQ, or any component of the Executive Office of the President, acting in their personal capacity;
- Who is employed by or contracting with a federal agency or entity other than CEQ, or any component of the Executive Office of the President acting in their personal capacity, should consult with an appropriate agency ethics official to determine whether the federal ethics rules will limit or prohibit the acceptance of nonmonetary recognition under the Program;
- Shall not be a reviewer for the Program, or any other party involved with the design, production, execution, or distribution of the Program or the immediate family of such a party (i.e., spouse, parent, step-parent, child, or step-child);
- In the case of an entity, it shall maintain a primary place of operations in the United States, and in the case of an individual, shall be a citizen or permanent resident of the United States. Foreign citizens may only enter as (i) employees of an otherwise eligible U.S. entity who reside in the U.S., (ii) full-time students at an otherwise eligible U.S. university or college who reside in the U.S., or (iii) owners of less than 50% of the interests in an otherwise eligible U.S. entity who reside in the U.S.;
- For individuals, shall be 18 years of age or older at the time of submission;
- Entrants are not eligible to receive any nonmonetary recognition in the Program if they are a person or entity designated or sanctioned by the United States Treasury’s Office of Foreign Assets Control (see http://www.treasury.gov/resource-center/sanctions/SDN-List/Pages/default.aspx for additional information). Each Entrant is required to ensure that any release or transfer of technical data to non-U.S. persons complies with International Traffic in Arms Regulations (ITAR) 22 C.F.R. §§ 120.1 to 130.17; and
- Shall comply with and abide by the decisions of the Program Parties which shall be final and binding in all respects.
Submissions Requirements
- Submissions must be submitted through the submission platform linked on permittinginnovators.com (the “Program Website”) by the entry deadline listed on the Program Website.
- If an Entrant is unable to submit an entry by the entry deadline because of a technical problem with the Program Website, the Entrant must immediately contact [email protected] and provide an explanation of the technical problem experienced. Reports of the technical problem must be received by the entry deadline. Luminary Labs will accept the Entrant’s submission if the Administrator can confirm that a technical problem occurred with the Program Website and that the technical problem affected the Entrant’s ability to submit an entry by the entry deadline in Luminary Labs’ sole discretion. Luminary Labs will contact the Entrant after a determination is made on whether the entry will be accepted. These extensions apply only to the unavailability of, or technical problems with, the Program Website.
Use of Funds and Resources
- Federal grantees may not use federal funds from a grant award to develop their Program submissions or to fund efforts in support of their Program submissions unless use of such funds is consistent with the purpose of their grant award.
- Federal contractors may not use federal funds from a contract to develop their Program submissions or to fund efforts in support of their Program submissions.
- An Entrant shall not be deemed ineligible to receive nonmonetary recognition through the Program because the Entrant used federal facilities or consulted with federal employees while developing its submission if the facilities and employees are made available to all Entrants on an equitable basis.
- Entrants must own or have access at their own expense to a computer, an Internet connection, and any other electronic devices, documentation, software, or other items that Entrants may deem necessary to create and enter a submission. Submissions must be made in English. All Program-related communication will be in English.
- Individuals with disabilities who need accommodation or auxiliary aid in connection with the submission process should contact the person listed under “For Further Information Contact” in the Rules, Terms, and Conditions at least one week prior to the entry deadline. Entrants who use a TDD or a TTY may call the Federal Relay Service (FRS), toll free, at 1-800-877-8339. If an accommodation or auxiliary aid to an individual with a disability is provided in connection with the submission process, the submission remains subject to all other requirements and limitations set forth in the Rules, Terms, and Conditions.
Waivers and Indemnification
- Each Entrant agrees to assume any and all risks and waive claims against the federal government and its agents and assigns, except in the case of willful misconduct, for any injury, death, damage, or loss of property, revenue, or profits, whether direct, indirect, or consequential, arising from involvement with this Program, whether the injury, death, damage, or loss arises through negligence or otherwise.
- Based on the subject matter of the Program, the type of work that it will possibly require, as well as an analysis of the likelihood of any claims for death, bodily injury, property damage, or loss potentially resulting from entering the Program, no Entrant is required to obtain liability insurance or demonstrate financial responsibility in order to be eligible under the Program.
- Each Entrant agrees to indemnify the federal government and its agents and assigns against third party claims for damages arising from or related to Program activities.
- The Program Website may contain links to third-party websites that are not owned or controlled by Program Parties. Program Parties do not assume any responsibility for any such third-party sites. If you access a third-party website from any Program-related website, you do so at your own risk and expressly relieve Program Parties from any and all liability arising from use of any third-party website content.
Use of Submissions and Intellectual Property
- Each Entrant warrants that they are sole author or owner of, or has the right to use, any copyrightable works that the submission comprises, that the works are wholly original with the Entrant (or is an improved version of an existing work that the Entrant has sufficient rights to use and improve), and that the submission does not infringe any copyright or any other rights of any third party of which the Entrant is aware. Each Entrant also warrants that the work submitted is free of security threats and malware.
- Each Entrant grants to CEQ an irrevocable, paid-up, royalty-free nonexclusive worldwide license to reproduce, publish, post, link to, share, create derivative works, and display publicly the submission on the web or elsewhere, throughout the world. Each Entrant will retain all other intellectual property rights in their submissions, as applicable. Each Entrant must warrant that there are no legal obstacles to providing the above-referenced nonexclusive licenses of the Entrant’s rights to the federal government. To receive nonmonetary recognition, Entrants will not be required to transfer any intellectual property rights to CEQ or another government entity, but Entrants must grant to the federal government the nonexclusive licenses recited herein.
- Each Entrant hereby irrevocably grants to Program Parties the right to the use of their name, affiliation, city and state, likeness or image, and a short synopsis of their solution as a part of Program-related promotion. Each Entrant must clearly delineate any confidential commercial information contained in a submission that the Entrant wishes to protect as proprietary data.
- Use of Marks: Except as expressly set forth in the Rules, Terms, and Conditions, Entrants shall not use the names, trademarks, service marks, logos, insignias, trade dress, or any other designation of source or origin subject to legal protection, copyrighted material or similar intellectual property (“Marks”) of CEQ, CEQ’s Permitting Innovation Center, or any component of the Executive Office of the President or other Program Parties in any way without such party’s prior written permission in each instance, which such party may grant or withhold at its sole and absolute discretion.
Additional Terms and Conditions
- Each Entrant agrees to follow all applicable federal, state, and local laws, regulations, and policies.
- Each Entrant must comply with all terms and conditions of the Rules, Terms, and Conditions, and submission of an entry to the Program constitutes each such Entrant’s full and unconditional agreement to abide by the Rules, Terms, and Conditions. Receiving and/or participating in any nonmonetary recognition and associated activities is contingent upon fulfilling all requirements herein.
- Program Parties reserve the right in their sole discretion to disqualify any Entrant who is found to be tampering with the entry process or the operation of the Program; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Program; or to annoy, abuse, threaten, or harass any other person; CEQ reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. If any Entrant selected for recognition has not complied with the Rules, Terms, and Conditions or otherwise is deemed ineligible, or declines nonmonetary recognition for any reason prior to award, the Entrant will be disqualified, and alternate recipients may be selected.
- Attempts to notify recipients of nonmonetary recognition will be made using the email address associated with the email address provided as part of the Entrant’s submission. Program Parties are not responsible for email or other communication problems of any kind. If, despite reasonable efforts, a potential recipient does not respond within three days of the first notification attempt regarding their selection status (or a shorter time as exigencies may require), or if the notification is returned as undeliverable, the Entrant’s selection may be forfeited, and an alternate recipient may be selected.
- Each Entrant hereby agrees that Program Parties may occasionally use Entrant information to contact Entrants about the Program and related activities; and acknowledges that Entrant has read and accepted the Privacy Policy published on the Program Website, as well as the submission platform Privacy Policy.
- Program Parties reserve the right to cancel, modify, or suspend the Program in whole or in part.
